Introduction

This data protection and data management notice (hereinafter: “Notice”) contains the rights and obligations and other important provisions related to the processing of personal data provided to the Data Controller during contact, available on the website www.raczgyerekek.hu (hereinafter: “Website”) operated by the “Együtt Kornélért és Zsomborért” Foundation (registered office: 6521 Vaskút, Táncsics Mihály utca 22., tax number: 19307893-1-03; hereinafter: “Data Controller”).

The processing and collection of personal data uploaded to the Website is carried out in accordance with the directly applicable legislation of the European Union and the provisions of the applicable Hungarian legislation. The processing of personal data is governed in particular by Act CXII of 2011 on the right to informational self-determination and freedom of information (hereinafter referred to as the “Information Act”), Act CVIII of 2001 on certain issues of electronic commerce services and services related to the information revolution, as well as the recommendations of the National Data Protection and Freedom of Information Authority and the data protection practices developed by it.

The Data Controller treats the personal data received confidentially and takes all measures to facilitate secure data management. The Data Controller's data protection officer can be reached at alapitvany@raczgyerekek.

Interpretative provisions

The following interpretative provisions have been determined based on the Information Act:

personal data: data that can be linked to the data subject (‘customer’) – in particular his/her name, address and one or more physical, physiological, mental, economic, cultural or social identity – and the conclusion that can be drawn from the data about the user, which is not considered to be public interest or public interest data. Personal data includes, among others, the name, address and e-mail address.

consent: a voluntary and definite expression of the user's will, based on adequate information, by which he gives his unambiguous consent to the processing of personal data concerning him, in full or in relation to certain operations.

Objection: a statement by the user objecting to the processing of his/her personal data and requesting the termination of data processing or the deletion of the processed data.

data controller: the natural or legal person or company with legal personality who, independently or jointly with others, determines the purpose of data processing, makes and implements decisions regarding data processing (including the means used), or has them implemented by a data processor commissioned by him.

data processing: any operation or set of operations performed on data, regardless of the procedure used, including in particular collection, recording, recording, organization, storage, alteration, use, retrieval, transmission, disclosure, alignment or combination, blocking, erasure and destruction, as well as preventing further use of data, taking photographs, audio or video recordings, and recording physical characteristics suitable for identifying a person.

Based on the above, the Data Controller is the data controller of all data that is considered personal data and is uploaded during registration and/or purchase on the Website.

Principles of data management

Personal data may only be used for a specific purpose, in order to exercise rights and fulfill obligations. Data processing must comply with this purpose at all stages. The Data Controller processes the recorded personal data in order to provide the service. The Data Controller only processes personal data whose recording is necessary for the customer to use the service and for the Data Controller to perform it in accordance with the contract.

The Website can be visited by anyone. The Data Controller does not collect or process data regarding visitors. When using the service (contact) available through the Website, the following data must be provided:

Personal data may be processed either on the basis of law or with the consent of the user. Accordingly, by providing the above data when contacting the Website and starting to use the service, the user expressly consents to (i) the use and processing of his/her personal data for the purposes specified in the paragraph “Purpose of data processing” below; and (ii) the storage of the data by the Data Controller in accordance with the conditions specified in this Notice.

Purpose of data processing

Our Customers can provide their personal data when contacting us via the Website, by telephone or by email in order for the Data Controller to be able to send the prepared offer or order confirmation to the user, and to initiate contact in case of questions. Duration of data management: until the purpose of data management is achieved, or until another date specified by law. Legal basis for data management: Act CVIII of 2001 on certain issues of electronic commerce services and services related to the information society, Section 13/A.

Data transmission, data processing

The Data Controller will not disclose the personal data provided during the contact to a third party without the user's prior consent - except to a transport or courier company to the extent necessary to achieve the purpose of the data management - in any way, except in cases where the Data Controller is obliged to transmit the data by legal requirement.

The Data Controller may use a data processing service to process the personal data it processes. During the provision of its services, the data processor is obliged to comply with the provisions of this Notice, the applicable laws in force, and the contract governing its legal relationship with the Data Controller. No data transfer takes place regarding the personal data processed by the Data Controller.

Anonymous data and “Cookies”

The Data Controller collects mostly anonymous information from the Website, such as searches. When a visitor visits the Website, the Data Controller does not collect any personal data unless the visitor gives permission to do so. The Data Controller processes the anonymous information in order to improve and improve the content of the site. In doing so, the Data Controller may install so-called “cookies”, which collect the visitor’s first-level domain name and the date and time of access. “Cookies” cannot be used by themselves to reveal the visitor’s identity. A “cookie” is a file that is sent to the visitor’s browser program and stored on the computer’s hard drive. “Cookies” do not damage the visitor’s computer. The browser program can be set to indicate when a “cookie” is received, and in this way the visitor can decide whether to accept the given “cookie” or not.

An anonymous visitor identifier (cookie) is a unique string of characters that is used for identification and information storage by service providers on visitors' computers. It is important to note that such a string of characters - given that the full IP address is not stored during its use - cannot in any way identify the customer, i.e. the visitor, but is only suitable for recognizing the visitor's machine. It is not necessary to provide a name, e-mail address or any other personal information, since when using such solutions, the service provider does not even ask the visitor for data, the data exchange actually takes place between machines.

This website uses Google Analytics, a web analytics service provided by Google Inc. (“Google”). Google Analytics uses so-called “cookies”, text files stored on your computer, which enable an analysis of your use of the website.

The information generated by the cookie about your use of the website (including your IP address) is transmitted to and stored by Google on servers in the United States.

Google will use this information to evaluate your use of the website, to compile reports on website activity for website operators and to provide other services relating to website activity and internet usage. Google may also pass this information on to third parties where required to do so by law or where such third parties process the data on Google's behalf. Google will not associate your IP address with other data held by Google. You may refuse the use of cookies by selecting the appropriate settings on your browser; however, please note that you may not be able to use all of the website's functions to their full extent. By using this website, you consent to the processing of data collected about you by Google in the manner and for the purpose described above.

Right to legal remedy

The customer/user may request information about the processing of his/her personal data, as well as request the correction of his/her personal data, or – with the exception of data processing prescribed by law – their deletion or modification at any time by sending an e-mail to the Data Controller at alapitvany@raczgyerekek.hu, by calling the Data Controller's telephone number, or by sending a letter to the Data Controller by post.

At the request of the customer, the Data Controller shall provide information on the data processed by it or by any data processor it may have commissioned, the purpose, legal basis, duration of the data processing, the name, address (registered office) of the data processor and its activities related to data processing, as well as on which persons receive or have received the data and for what purpose. The Data Controller, as the data controller, shall provide the information in writing and in a plain language as soon as possible after receipt of the request, but no later than within 30 calendar days. The information is free of charge if the person requesting the information has not yet submitted a request for information to the Data Controller in the same area in the current year. In other cases, the Data Controller may determine a cost reimbursement.

The Data Controller will delete personal data immediately if (i) the registered user notifies it in writing by sending an electronic message to the e-mail address alapitvany@raczgyerekek.hu, or by sending a statement addressed to the Data Controller and delivered by post to the Data Controller's registered office; (ii) if its processing is unlawful, (iii) the purpose of the data processing has ceased to exist, or (iv) the statutory deadline for storing the data has expired, or it has been ordered by the court or the National Data Protection and Freedom of Information Authority.

The Data Controller shall notify the affected customer of the correction and deletion by e-mail, stating that if the legitimate interests of the affected user are not violated in view of the purpose of the data processing, the Data Controller may omit the notification. The customer may object to the processing of his or her personal data if the processing of the personal data is necessary solely for the exercise of the rights or legitimate interests of the data controller, unless the data processing is ordered by law; the use of the personal data is for the purpose of direct marketing, public opinion polling or scientific research; otherwise, the exercise of the right to object is permitted by law.

The Data Controller shall examine the objection immediately, but no later than within 15 calendar days after the objection is made, and shall inform the user of the result in writing. If the objection is justified, the Data Controller shall terminate the data processing. If the affected user does not agree with the Data Controller’s decision, he/she may appeal against it – within 30 calendar days of its notification – to a court or to the National Data Protection and Freedom of Information Authority (seat: 1125 Budapest, Szilágyi Erzsébet fasor 22/C., website: http://www.naih.hu). The Data Controller may not delete the data of the affected user if the data processing was ordered by law. The affected user may appeal against the data controller in the event of a violation of his/her rights. The court shall proceed with the case ex officio.

The Data Controller reserves the right to amend the Information in the event of changes to the Information or to European Union or Hungarian legislation.

This Notice shall enter into force on September 10, 2021 and shall apply to all registered users and to users who contact the Data Controller through the Website without registration. Registered users and users who place orders on the Website without registration undertake to comply with this Notice.
